MyHolidayPartner Terms and Conditions

1. This document sets out the rights and obligations of MyHolidayPartner and its clients and forms a legally binding contract between MyHolidayPartner and its clients. 'MyHolidayPartner' and 'MyHolidayPartner.com' refer to the www.myholidaypartner.com website, its owners and operators, their directors and employees and anyone associated with the running of the website. 'Clients' refers to anyone visiting or placing information on the MyHolidayPartner website or using it in any way whatsoever whether or not any form of payment has been made. By using the site you agree to the terms and conditions set out in this agreement. This agreement may change from time to time without notice.

2. There are two types of membership of MyHolidayPartner. Ordinary members who have not paid a membership fee, and full members, who have paid a membership fee. Ordinary members may register their details and use the search facility on the website to search for other members, either ordinary or full. Full members may, in addition, have access to the messaging system on the MyHolidayPartner website where they may send and receive messages with other full members. Both ordinary and full members may receive e-mails from MyHolidayPartner from time to time

3. On payment of the membership fee clients will become a full member for the period represented by the membership fee paid at the rate prevailing at the time of payment, as set out on the MyHolidayPartner website. During the period of full membership clients may contact and receive messages from as many other full members as they wish. On expiration of the membership period clients revert back to the basic free membership and may no longer use the messaging system on the MyHolidayPartner website. Clients may enjoy continuous use of the messaging system by either extending their full membership before it expires or rejoining MyHolidayPartner after its termination. In either case this will be at the then current subscription rate, and under the then current terms and conditions. If clients choose not to pay any of the current fees for any of the available membership periods membership will become ordinary and clients will no longer have access to the messaging system until a further membership fee is paid.

4. MyHolidayPartner do not guarantee the content of results produced when using the search facility nor that any results will be produced at all. Furthermore MyHolidayPartner do not guarantee that a suitable holiday partner can be found for any client whether or not a membership fee has been paid.

5. Messages posted to the messaging system will be deleted after a period of one month after being read by the recipient. Messages that remain unread for a period of one month will be deleted after a period of a further month. This means two months after the time of posting into the messaging system.

6. While we encourage members to reply to all messages received we can give no guarantee that they will do so.

7. When a client registers with MyHolidayPartner they must provide accurate information about themselves. Any fees payed must be using a credit or debit card which the client is fully entitled to use, and which has sufficient funds available to cover the charge.

8. MyHolidayPartner provides a place where full members may contact and communicate with each other, but does not screen messages between members, and cannot be responsible for the behaviour of members or ensure that any information provided is accurate.

9. There may be times when the MyHolidayPartner web site is unavailable due to technical problems or for site maintenance, with or without notice. In this case no refund of membership fees will be given.

10. For security reasons you may be requested to change your password from time to time.

11. MyHolidayPartner reserves the right to terminate membership and to remove or edit material posted on the site. If MyHolidayPartner terminates a membership that client may not rejoin without our permission.

12. Members must not post details of their e-mail address, postal address, telephone number or IP address or link to any other website on the MyHolidayPartner site.

13. Members may not use the MyHolidayPartner site for any advertising or other commercial purpose, or for the sending of bulk e-mail.

14. MyHolidayPartner are entitled to alter the amount of the fees from time to time.

15. Fees paid to MyHolidayPartner will not be refunded unless the site is closed down. In the event of the site being closed down a partial refund will be made dependent on the unexpired term of the full membership.

16. Members are responsible for ensuring that no material posted on the site or in messages forwarded via MyHolidayPartner infringes the rights of any other person or entity, breaches any laws, or is offensive, threatening, abusive, discriminatory, obscene, libelous, inflammatory, defamatory, false, unreliable or misleading or could be regarded as propaganda in any form whatsoever, including but not restricted to religious, political or any other.

17. Material posted on the site and messages between members are not monitored by us, so members are requested to contact us and report any material which appears to infringe these terms and conditions.

18. Material found to be in breach of these terms and conditions will be withdrawn.

19. MyHolidayPartner is not responsible for the accuracy of material posted on the site or communicated in messages between members.

20. MyHolidayPartner does not endorse or have any responsibility for other web sites linked to MyHolidayPartner.com.

21. Members should exercise caution when appraising accuracy of information provided by other members both on the site and in messages between members using any other method.

22. Use of the MyHolidayPartner.com website is entirely at the client's own risk.

23. Material appearing on the MyHolidayPartner website may not be copied or used in any way except by prior permission from MyHolidayPartner.

24. Material posted to the site by members may be copied, modified and used by MyHolidayPartner in any way MyHolidayPartner thinks fit.

25. MyHolidayPartner will not be liable to clients or any third party for any loss or damage to persons or property howsoever caused.

26. Use of the chat room on the MyHolidayPartner website does not form part of this membership agreement. It is a privilege afforded to full members and not a right under this agreement. It may be withdrawn at any time without notice. As use of the chat room does not form part of the membership agreement no refund of membership fees in full or in part will be given in the event of said withdrawal.

27. Members using the chat room on the MyHolidayPartner website must do so sensibly and with due respect for other users. Any member causing disruption or exhibiting behaviour which MyHolidayPartner feel in any way causes upset or discomfort to other users will be banned from the chat room facility without recourse to recompense.

28. Use of the games room on the MyHolidayPartner website does not form part of this membership agreement. It is a privilege afforded to full members and not a right under this agreement. It may be withdrawn at any time without notice. As use of the games room does not form part of the membership agreement no refund of membership fees in full or in part will be given in the event of said withdrawal.

29. This agreement may be changed from time to time. If terms and conditions are changed the new agreement will have immediate effect and members will be notified by email at the email address they have supplied in their membership profile.

30. Even in the event that a part of this agreement is held to be invalid the remainder of this agreement will remain valid.
